Terms of Use
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Mojo Moments ("Mojo Moments," "we," "us," or "our"), which operates Mojo Academy (the "Platform"). By using the Platform, you agree to these Terms and acknowledge our Privacy Notice, which explains how we handle your information.
You must be at least 18 years old to use the Platform. If you use it on behalf of an organization, you confirm that you are allowed to accept these Terms for it. If you have a separate written agreement with us for a program or certification (a "Program Agreement"), that agreement controls where it conflicts with these Terms.
2. Accounts and sign-in
- Accounts are created by invitation. Keep your account information accurate, and tell us if your email address changes.
- We sign you in with one-time links sent to your email. Keep access to that inbox secure and do not forward sign-in links. Your account is for you alone; do not share it or let anyone else use it.
- You are responsible for activity on your account. Tell us right away if you think someone else has used it.
3. Assessments and certification
- Your own work. Complete practice and certification assessments yourself, without help from other people, AI tools, or outside materials unless the instructions for that assessment allow them.
- How scoring works. AI suggests scores for assessments, and a Master MojoCoach reviews and scores every assessment that counts toward certification. Some practice scenarios, such as voice delivery feedback, give you AI-generated feedback directly, without review, and are not used for certification decisions. Certification decisions are made by people at Mojo Moments under the requirements of each program. You can ask us to review a result with you (see the Privacy Notice).
- Confidential assessments. Scenarios, scoring guides, and assessment materials are confidential. Do not copy, record, share, or publish them, or describe them in a way that would help others prepare answers.
- Using your certification. A certificate shows that you met the program's requirements on the date issued. What it authorizes you to do, including teaching or using the Mojo methodology with your own clients, is set by your Program Agreement.
- Revocation. We may withhold or revoke a certification that was obtained through misconduct, such as cheating, impersonation, or misuse of assessment materials. We will tell you why and give you a chance to respond first.
4. Fees and program agreements
Fees for courses, certification, and memberships, along with any refund terms, are set out in your Program Agreement or in the terms shown when you buy. We do not currently take payments on the Platform. If we add online purchases, the purchase terms and refund policy will be shown before you pay.
5. Community membership
Some courses and purchases include membership in the Mojo Academy community. A "lifetime" membership lasts for as long as Mojo Moments operates the community, and is personal to you (it cannot be transferred or shared). Membership continues only while you follow these Terms; we may suspend or end it for serious or repeated violations of section 6.
6. Acceptable use and conduct
Treat everyone on the Platform with respect. When you use the Platform, you agree not to:
- harass, threaten, bully, or discriminate against anyone, or post hateful, sexual, or violent content;
- share confidential or identifying information about your coaching clients, employer, or anyone else without their permission;
- post spam, advertising, or sales pitches unless the community allows it in a specific space;
- pretend to be someone else, or misrepresent your credentials or certification;
- post content you do not have the right to share, or content that breaks the law;
- copy, scrape, download in bulk, or republish course content, scenarios, or other members' posts;
- try to get around security or access controls, probe the Platform for weaknesses, or disrupt it, unless we have given you written permission to test it;
- reverse engineer the Platform or its scoring, or use it to build a competing product; or
- use the Platform in a way that harms Mojo Moments, other members, or the public.
We may remove content that breaks these rules. Report concerns to susan.fowler@mojomoments.com.
7. Your content
You keep ownership of what you post or submit, such as comments, profile details, feedback, and your responses in scenario sessions ("Your Content"). You give Mojo Moments a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and process Your Content to run the Platform, deliver and score your courses and assessments, and check and improve the quality and fairness of assessment scoring. This license ends when Your Content is deleted, except for copies kept as described in the Privacy Notice.
We will quote your feedback publicly as a testimonial only if you give permission, and you can withdraw that permission at any time. If you send us suggestions or ideas about the Platform, we may use them without owing you anything.
8. Our content
Courses, scenarios, scoring guides, videos, the Mojo methodology, and other materials on the Platform belong to Mojo Moments or its licensors, and the Platform software belongs to its developer. They are protected by copyright, trademark, and other laws. We give you a limited, personal, non-transferable license to use them for your own learning while you have access. You may not copy, sell, license, or create derivative works from them except as your Program Agreement allows.
9. AI features
The coaching clients in scenarios are simulations played by AI; they are not real people. AI-generated responses, suggested scores, and feedback can be incomplete or wrong. They are provided for learning, are reviewed by people where they affect certification, and are not professional, medical, legal, or mental health advice.
10. Third-party services
The Platform may include videos, links, or tools from other companies, such as YouTube and Vimeo. Those services have their own terms and privacy policies, and we are not responsible for them.
11. Suspension and termination
You may stop using the Platform at any time and ask us to delete your account. We may suspend or end your access if you break these Terms, if your organization's or program's access ends, or if we need to in order to protect the Platform or others. Where it is reasonable, we will give you notice and a chance to download your data first. Sections 3 (revocation), 7, 8, and 12 through 14 continue after your access ends.
12. Disclaimers
We work hard to keep the Platform accurate and available, but it is provided "as is" and "as available." To the extent the law allows, Mojo Moments disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not promise that the Platform will be uninterrupted or error-free. Certification does not guarantee any job, client, income, or result.
13. Limitation of liability
To the extent the law allows, Mojo Moments and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to the greater of the amount you paid us for the program the claim relates to in the 12 months before the claim, or US $100. Some places do not allow these limits, so they may not all apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that cannot be resolved that way will be handled in the state or federal courts located in San Diego County, California, and you and we agree to those courts' jurisdiction. If you live outside the United States, you keep any rights your local consumer laws give you.
15. Changes to these terms
We may update these Terms. We will post the new version here with a new effective date, and if a change is significant we will tell you by email or when you next sign in, and ask you to accept it before continuing. If you do not agree to the updated Terms, stop using the Platform and contact us to close your account.

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, the Privacy Notice, and any Program Agreement are the entire agreement between you and us about the Platform.
